These ordinances have been <br />tailored after the Bloomington ordinance which other cities have also <br />followed. Attached to this report is a memo from the City Attorney, David <br />Sellergren, explaining the differences between the two draft ordinances that <br />have been included in the packet. <br /> <br />Public Hearing to Review Closure Statement <br /> <br />The public hearing for the submitted closure statement of Elk Terrace Mobile <br />Home Park has not been closed; therefore, the City Council will still be <br />allowed to receive additional testimony from any of the residents, park <br />owner, or other parties interested in this matter. Staff has not received any <br />new information since the last Council meeting; therefore, no new backup <br />material has been included in your packet. However, I have attached a copy <br />of the information which was presented at the January 21st City Council <br />meeting by park resident, Shawn Sieban. <br /> <br />Also included is a copy of State Statues 327C.095 PARK CLOSINGS. along <br />with other information that has previously been submitted to the Council. <br /> <br />General Information <br /> <br />In an attempt to try and summarize information surrounding this park <br />closure request the following is being provided for the City Council: <br /> <br />· Mobile home park is approximately 8 acres in area. <br />· Hohlens own approximately 57 acres adjacent to the mobile home park. <br />· Current zoning of the mobile home park is C3 (Highway Commercial). <br />· Current zoning of the remaining portion of the Hohlen property is PUD. <br /> (Planned unit Development) and Rlc (Single Family Residential). <br />· According to Mr. MacGibbon's letter dated 1/15/97, 32 mobile home units <br /> remain in Elk Terrace Mobile Home Park. <br />· Closure statement to close the park was received by the City Council on <br /> September 24, 1996. <br />· June 24, 1997 will mark the nine month notification requirement prior to <br /> closing the park. <br /> <br />Recommendation <br /> <br />The City Council should receive any new public information that can <br />be provided and consider this in reviewing the closure statement. <br />Once the testimony has been received, the Council may close the public <br />hearing.
