RESOLUTION 10- <br />A RESOLUTION OF THE CITY OF ELK RIVER <br />A RESOLUTION REMOVING PARCEL 75-409-0740 FROM THE SPECIAL ASSESSMENT <br />ROLL FOR THE 2010 MAIN STREET REHABILITATION PROJECT <br />WHEREAS, the final Assessment Roll for the 2010 Main Street Rehabilitation Project was <br />approved on June 28, 2010, and parce175-409-0740 was included in this final Roll; and <br />WHEREAS, property owner, John MacGibbon made written objection to the assessment, prior to <br />the Assessment Hearing, stating the subject parcel is unbuildable; and <br />WHEREAS, the City Council directed Mr. MacGibbon to combine the unbuildable parcel with an <br />adjacent parcel he owns; and <br />WHEREAS, after adoption of the final Assessment Roll it was determined by Sherburne County <br />that the parcels could not be combined due to a street located between the two properties. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of the Ciry of Elk River, Minnesota <br />hereby removes Parcel 75-409-0740 from the Special Assessment Roll for the 2010 <br />Main Street Rehabilitation Project because it is unb~aildable and can't be combined <br />with the property owner's adjacent parcel. <br />Passed and adopted this 16`'' day of August 2010. <br />:.., <br />Stephanie Klinzing, Mayor <br />ATTEST: <br />Tina Allard, City Clerk <br />C:\Documents and Settings\XPMUser\Local Settings\Temporary Internet Files\OLK66\Acdon Requested-MacGibbon.doc <br />
