THE APPLICANT SHALL POLICE THE PARKING LOT AND <br />PREVENT LOITERING BY PATRONS. <br /> <br />Plannin& Commission Action <br /> <br />The Planning Commission conducted a public hearing regarding the request at its April 22, <br />2003 meeting. Jeff Bruan, 626 Fulcom Avenue, Minneapolis, representing the applicant was <br />in attendance to answer any questions that the Commission had. There were number of <br />questions from the Commission regarding the operation of the facility and the condition of <br />the building/site. <br /> <br />Robert and Carol Hall and Greg Bossany spoke against the proposed facility. Dennis <br />Dahlen, attorney representing the Halls had a number of questions regarding the <br />moratorium and the pending litigation. <br /> <br />Recommendation <br /> <br />Staff and the Planning Commission recommend that the City Council approve the request <br />for a conditional use permit to operate a go-kart facility at 321 Baldwin with the following <br />conditions: <br /> <br />1. THE GO-KART OPERATION SHALL COMPLY WITH ALL OF THE <br />BUILDING CODE REQUIREMENTS. <br /> <br />2. THE APPLICANT SHALL PROVIDE PROPER FLAMMABLE <br />MATERIAL STORAGE. <br /> <br />3. THE SPRINKLER SYSTEM SHALL BE MODIFIED TO ADDRESS THE <br />CHANGE IN OCCUPANCY. <br /> <br />4. THE APPLICANT SHALL POST AND ENFORCE THE CITY OF ELK <br />RIVER'S CURFEW REQUIREMENTS. <br /> <br />5. THE APPLICANT SHALL POLICE THE PARKING LOT AND <br />PREVENT LOITERING BY PATRONS. <br /> <br />6. ENTRANCE DOORS SHALL REMAIN CLOSED DURING HOURS OF <br />OPERATION. <br /> <br />7.
