New Rules for Employee Time Off to Vote <br />Page 1 of l <br />~~ <br />~~nt~u L ,., <br />,rv11~~ ~~ r tior,~ <br />('l lltti <br />New Rules for Employee Time <br />Off to Vote <br />A new law expands time off provision from morning only to all day. <br />(Published Jul 21, 2010) <br />The 2010 Legislature expanded the oppoRunlty for employees to be absent from work without penalty to <br />vote. Legislators deleted the provision that had previously allowed such absences only in the morning of <br />Election Day. The new law became effective on April 2, and will be in force for the 2010 state primary <br />on Aug. 10 and for the general election on Nov. 2. <br />Every employee who is eligible to vote has the right to be absent without penalty or loss of salary or <br />wages. The actual new language provides [hat employees have the right to be absent from work "for the <br />time necessary to appear at the employee's polling place, cast a ballot, and return [o work on the day of <br />that election." <br />According to Minnesota Statutes, seCtlOn 2O4C.O4 (Link to https rrwww.revisor mn.gov/sta(u(esOid=204C 04J , employers <br />or others may not either directly or indirectly refuse or otherwise interfere with an employee's right to <br />take the time to vote on Election Day.
