ORDINANCE 10- <br />CITY OF ELK RIVER <br />AN ORDINANCE OF THE CITY OF ELK RIVER <br />AMENDING SECTION 50-I 17 OF THE CITY CODE OF ORDINANCES RELATING TO <br />HUNTING AND SHOOTING NEAR PARKS AND TRAILS <br />The City Council of the City of Elk River does hereby ordain as follows: <br />Section 1. That Section 50-117 titled Hunting and shooting of Elk River City Code <br />shall be amended to read as follows: <br />Sec. 50-117. Hunting and shooting. <br />(a) Generally; written permission required. Hunting ox shooting upon land within the city may be <br />conducted with the written permission of the landowner except as prohibited in this section. No <br />permission shall be required for the owner of such land, or members of the owner's immediate <br />family or guests in the company of the owner of the land. <br />(b) Prohibited areas. The discharge or use of a dangerous weapon shall be prohibited in the <br />following locations: <br />(1) Within 1,000 feet of the ordinary high-water mark of Lake Orono or the Elk River. <br />(2) Within 500 feet of any building or structure or any platted area. This minimum 500- <br />foot distance may be reduced to 200 feet in the following circumstances: <br />a. At an organized gun club as defined in section 50-118 for the discharge of shotguns at <br />a trap range from a currently existing permanent shooting pad directed away from the <br />building or platted area; or <br />b. At an organized biathlon range for the discharge of low velocity rifles at an <br />established shooting range directed away from the building ox platted area. <br />(3) On lands not zoned R-1a, A-1, I-1 or I-2, except that discharge or use of dangerous <br />weapons shall be prohibited on lands zoned I-1 or I-2 if such zoning districts axe <br />contiguous on two or more sides to lands zoned R-1b, R-1c, R-2, R-3, R-4 or PUD. A <br />request ul writing to hunt in areas that would otherwise be prohibited by this subsection <br />(3) may be approved by the chief of police, if the request complies with subsection (b)(2) <br />of this section and no other extenuating circumstances exist. <br />(4) On platted lands zoned R-1a. <br />(51 Within 500 feet of an~public_park~trail, or public/private school unless in the <br />following circumstances: <br />1 At an organized biathlon range in a public ark for the discharge of low velocity rifles <br />at an established shooting range directed away from the building or platted area. <br />2 Allow hunting within 500 feet b~permit only Closing of the trail during the firearm <br />hunting season location to be determined by the jurisdiction of the Police Department. <br />(c) Notwithstanding the provisions of subsection (b) of this section: <br />(1) The discharge or use of BB guns, pellet guns and slingshots in a safe manner by <br />adults over the age of 18 years, or by minors under the age of 18 years who are under the <br />\\tsclient\S\Public Bodies\Council\Ordinances\2010\Pazk Hunting Policy Ordinance Attachment.DOC <br />
