ORDINANCE 10- CITY OF ELK RIVER AN ORDINANCE OF THE CITY OF ELK RIVER AMENDING SECTION 50-I 17 OF THE CITY CODE OF ORDINANCES RELATING TO HUNTING AND SHOOTING NEAR PARKS AND TRAILS The City Council of the City of Elk River does hereby ordain as follows: Section 1. That Section 50-117 titled Hunting and shooting of Elk River City Code shall be amended to read as follows: Sec. 50-117. Hunting and shooting. (a) Generally; written permission required. Hunting ox shooting upon land within the city may be conducted with the written permission of the landowner except as prohibited in this section. No permission shall be required for the owner of such land, or members of the owner's immediate family or guests in the company of the owner of the land. (b) Prohibited areas. The discharge or use of a dangerous weapon shall be prohibited in the following locations: (1) Within 1,000 feet of the ordinary high-water mark of Lake Orono or the Elk River. (2) Within 500 feet of any building or structure or any platted area. This minimum 500- foot distance may be reduced to 200 feet in the following circumstances: a. At an organized gun club as defined in section 50-118 for the discharge of shotguns at a trap range from a currently existing permanent shooting pad directed away from the building or platted area; or b. At an organized biathlon range for the discharge of low velocity rifles at an established shooting range directed away from the building ox platted area. (3) On lands not zoned R-1a, A-1, I-1 or I-2, except that discharge or use of dangerous weapons shall be prohibited on lands zoned I-1 or I-2 if such zoning districts axe contiguous on two or more sides to lands zoned R-1b, R-1c, R-2, R-3, R-4 or PUD. A request ul writing to hunt in areas that would otherwise be prohibited by this subsection (3) may be approved by the chief of police, if the request complies with subsection (b)(2) of this section and no other extenuating circumstances exist. (4) On platted lands zoned R-1a.
