TILLER CORPORATION APPLICATION FOR AMENDMENT TO <br />CONDITIONAL USE PERMIT <br />FOR MINERAL EXTRACTION <br />INTRODUCTION <br />Tiller Corporation (Tiller) is seeking an amendment to an existing Conditional Use <br />Permit (CUPj for Mineral Extraction on parcels of land located in the northern <br />portion of Elk River. The permit was issued in May, 1996. The proposed <br />amendments are limited to Condition #20 of the current CUP. <br />The proposed amendment involves mining the southern boundary of the Elk <br />River Landfill, Inc.'s (ERL) property. Condition #20 of the CUP requires no <br />mining operations be conducted, and trees be left in place, within 200 feet of <br />property lines. The amendment seeks to allow removal of trees and mining <br />within the area that is 200 feet from the south property line. <br />Figure 1 is a general location map of the site. Figure 2 illustrates the existing <br />mining setbacks and proposed revisions to mining setbacks. Figure 3 is a USGS <br />Quad Excerpt. <br />Site operations will be consistent with the current CUP. Operations will consist of <br />stripping the area to be mined, removing the aggregate with a front end loader, <br />screening and crushing the material and hauling it north or south to Tiller's <br />existing processing area. There is a haul road established between ERL's <br />property and Tiller's property. <br />II.
