September 21 and October 19, 2009 decisions regarding the March 2009 Application, including <br />the staff reports presented to the City Council, along with the resolutions adopted by the Crty <br />Council denying the March 2009 Application, are hereby incorporated in the City Council's <br />consideration and decision with respect to the current Application. <br />8. Subsequent to denial of the March 2009 application, the City Council has acted, <br />on March 16, 2010, on City-initiated amendments to the City's Solid Waste Facilities ordinance; <br />has acted, on April 19, 2010, to zone the Landfill property located within the City between <br />Highway 169 and the City trail and North of the SDA into the Solid Waste Facilities Overlay <br />Zoning District; and has acted, on May 17, 2010, to guide the Landfill property located within <br />the City between Highway 169 and the City trail and North of the SDA "Landfill" on the land <br />use plan element of the City's 2004 Comprehensive Plan. The information submitted in <br />connection with these actions, including the staff reports presented to the City Council and the <br />resolutio s ado ted b the i c' ' <br />n p y C ty Council, are hereby incorporated m the City Coun it s <br />consideration and decision with respect to the current Application. <br />9. The Application presently before the City Council to amend the existing CUP and <br />SWFL proposes to expand the Landfill by developing the existing 200-foot buffer zone on the <br />southern boundary of the Landfill for the deposit of solid waste. <br />10. Although the application materials submitted with the Application indicate that, <br /> <br />from an overall engineering standpoint, the design of the proposed expansion into the buffer area <br />is feasible, ERL has not submitted sufficient materials, including engineering and construction <br />details related to the leachate management system, a detailed storm water management plan, <br />design details for the Landfill gas system, and others, for the City to approve the requested <br />amendment to the CUP and SWFL. <br />4 <br />
